We provide podcast services (including, but not limited to, creation, development, production, post-production and distribution), audio and video content, physical and digital StoriDots and the associated web pages, recording studios, and other audio and video services which may be developed from time to time with interactive features, as well as the associated platforms, user interfaces, software applications and websites (“Sites”), social media accounts, apps, media players, and live events, focused on business, technology, entrepreneurship and lifestyle (collectively, the “Services”). Our trademarks, apps, and Sites are owned by, and all Services are provided by, Open Source Business Inc. or its subsidiaries (collectively, “MouthMedia,” “we”, “our”, or “us”).
Please take a few moments to read through this Privacy Policy (“Policy”) and review our Terms of Service (“Terms”) carefully. The Terms and Policy govern your access to, and use of, our Sites and Services. The Policy explains how we collect, use, share, and disclose information that you provide to us and your rights. Your access to and use of our Sites and Services is express consent to our collection, storage, transmission, use, and disclosure of your information as it is described in this Policy. If you do not consent to anything within this Policy, do not use the Site or Services.
This Policy does not apply to the practices of third parties that we do not own or control, including but not limited to any third party websites, services and applications (“Third Party Services”) that you elect to access through the Sites or Services or to individuals that we do not manage or employ. While we attempt to facilitate access only to those Third Party Services that share our respect for your privacy, we cannot take responsibility for the content or privacy policies of those Third Party Services. We encourage you to carefully review the privacy policies and terms of service of any Third Party Services you access.
INFORMATION YOU PROVIDE
As a listener, subscriber, purchaser, publisher, or advertiser using our Sites or Services, you may be prompted to share information with us from time to time. In addition, logging in to the Sites or Services via LinkedIn or Facebook or similar social media accounts, provides us information about those accounts. You may provide usernames, email and other information if you choose to use that method to sign up with us. You may also provide additional information, if you choose to fill out a profile, submission or registration form, and information on friends and connections if you choose to use the social aspects of the Sites or Services.
If you use our StoriDot Services, you may be prompted to provide certain personal data in order for you to purchase and then use our Services. This data may include your username and password, email address, phone number, birth date, gender, street address and country, as well as payment information. You may also provide User Content (as defined in the Terms) in connection with your use of our StoriDot Services, such as audio and video recordings, photos, and url information. Please note that we will never scan or import your devices library or camera roll.
If you complete any forms or respond to surveys or questionnaires, we collect the personal data that you provide to us.
Additionally, when you share links on social media or post information to third party websites, we capture information about such uses. Please be sure that you understand the terms and conditions of such third party providers. When you provide your contact information to a publisher, you are giving them permission to contact you. When you make a purchase, you are providing billing information and are authorizing a transaction. We may collect financial information, such as credit card information, through a Third Party Service if you purchase one of our StoriDot Services or other Services
YOU SHOULD ASSUME THAT ANY AND ALL DATA THAT CAN BE ACCESSED BY SCANNING A STORIDOT, OR SHARING ITS CONTENTS THROUGH SOCIAL MEDIA, CAN BECOME AVAILABLE TO THE PUBLIC. DO NOT INCLUDE, OR LINK TO, ANY DATA ON YOUR STORIDOT THAT YOU WISH TO KEEP PRIVATE.
INFORMATION WE COLLECT
Our Sites and Services automatically collect and log information about usage of, and interactions with, StoriDots and our other Services. We may collect information about customization and usage preferences to help provide you with accurate recommendations. We also track interaction behavior within the Services in an anonymized manner to help parties improve their offerings. As part of this, we may use information about your systems and geographic information. Some features of our Services may allow you to provide content to us. Any content that you provide may be retained by us indefinitely.
As an anonymous listener, we may capture session information.
We may collect information using Cookies. Cookies are pieces of text that may be provided to your computer through your web browser when you access a website. Your browser stores cookies in a manner associated with each website you visit. We use cookies to enable our servers to recognize your web browser and tell us how and when you visit the website and otherwise use the Services through the Internet. Our cookies do not, by themselves, contain personal information, and we do not combine the general information collected through cookies with other personal information to tell us who you are. As noted, however, we do use cookies to identify that your web browser has accessed aspects of the Services and may associate that information with your account if you have one. We may automatically collect your IP address or other unique identifier (“Device Identifier”) for the Device (computer, mobile phone, tablet or other device) you use to access the Services. A Device Identifier is a number that is assigned to your Device when you access a website or its servers, and our computers identify your Device by its Device Identifier. We may use a Device Identifier to, among other things, administer the Services, help diagnose problems with our servers, analyze trends, track users' web page movement, and gather broad demographic information for aggregate use.
While we collect and store IP address information, that information is not made public. We do at times, however, share this information with our partners, service providers and other persons with whom we conduct business, and as otherwise specified in this Policy.
USAGE OF INFORMATION YOU PROVIDE OR WE COLLECT
Our goal is to provide you with the best Sites and Services and to constantly improve our Services, Sites, and products. We are capturing information to provide better recommendations, develop our user interfaces, and provide more relevant products and services, podcasts, and ads to you. We may also use information that is gathered for our marketing materials and we may use some information for commercial purposes such as obtaining new clients or selling advertising.
To support and enhance our Sites and Services, we may now or in the future serve advertisements, and also allow third parties advertisements, through StoriDots, or our Sites or other Services. These advertisements are sometimes targeted and served to particular users and may come from third party companies called “ad networks.” Ad networks include third party ad servers, ad agencies, ad technology vendors and research firms.
Advertisements served through our Services may be targeted to users who fit a certain general profile category and may be based on anonymized information inferred from information provided to us by a user, including personal information (e.g., name), may be based on the Services usage patterns of particular users, or may be based on your activity on Third Party Services. We do not provide personal information to any ad networks for use outside of the Services.
In addition, some of the information that you provide may become public by default (such as content you include or share when using StoriDots or post publicly on our social media accounts).
INFORMATION THAT WE SHARE
Third Parties Services on our Behalf. We may work with Third Party Services to help us understand the users of our Sites and Services. We may provide our data partners with data sufficient to build usage and demographic profiles. Doing so helps to improve content and helps advertisers provide information about products that are relevant to listeners of a specific podcast or users of a specific Service. We also may use this information to generate more accurate search results and recommendations. We may generate reports on listener audiences from the anonymized interaction data. These reports may rely on Third Party Services to process the information flow, so we may send data to our Third Party Service providers.
Maintaining our Sites and Services. Our employees, affiliates, consultants, contractors, distributors, publishers, suppliers, and vendors, including the vendors who process payments to us, may receive access to a portion or all of the information gathered, depending on their roles. These include maintaining and improving our Sites and Services, processing data and payments, marketing our Sites and Services or individual podcasts, and teaching others how to use our Services. We only provide access to information as necessary to perform the respective roles.
Legal Disclosure. We may transfer and disclose your information to third parties to comply with a legal obligation; when we believe in our sole discretion that the law or a governmental authority requires it; to verify or enforce our Terms or other applicable policies; to address fraud, security or technical issues; to respond to an emergency; or otherwise to protect our rights or property or security of third parties, visitors to our Sites or Services or the public.
Business Transfers. In the event that we are involved in a bankruptcy, merger, acquisition, reorganization, or sale of assets, your information may be sold or transferred as part of that transaction, subject to this Policy. However, the acquiring company may change this Policy thereafter.
Anonymized Data. We anonymize and aggregate all interaction data that we provide to publishers and advertisers. It may be possible, however, for this anonymized data to be processed in such a way so as to identify you individually.
SECURITY
We keep your personal data only as long as necessary to provide you with the Services, and for legitimate and essential business purposes, such as maintaining the performance of our systems, making data-driven business decisions, complying with our legal obligations and resolving disputes. We use commercially reasonable security measures to protect your information, but please note that no system is ever completely secure. We cannot guarantee or warrant the security of the information that you provide us and use of the Sites and Services is at your own risk.
EMAIL ANNOUNCEMENTS AND NEWSLETTERS
We use email as part of some of our Services, and to send announcements regarding new products, services, events and/or promotions, and informational newsletters. Announcements via email are on an opt-in basis only. You can choose to unsubscribe from MouthMedia email at any time by sending an email to radar@mouthmedianetwork.com. We will also send replies to customer emails via email. Finally, if you have sent a request to us about which we need to communicate with you, we may do so by email.
CHILDREN’S ONLINE PRIVACY PROTECTION RULE COMPLIANCE
Our Services are not directed to children under the age of 18. Parents or guardians may set up an account for a child between the ages of 14 and 18. We do not collect information about or from children under the age of 13 and usage of our Services by a child under the age of 13, other than through a Parent account, is a violation of our Terms.
OTHER SITES
Our Sites and Services, including our StoriDots, may contain links to other sites that we do not own or operate. This includes links from advertisers, sponsors and/or partners that may use our logo(s) as part of a co-branding or co-marketing agreement. We do not control, recommend or endorse and are not responsible for these sites or their content, products, services or privacy policies or practices. These other sites may send their own cookies to your device, they may independently collect data or solicit personal information and may or may not have their own published privacy policies. You should also independently assess the authenticity of any site which appears or claims that it is one of our Services (including those linked to through an email or social networking page).
AMENDMENTS
We may amend this Policy from time to time. Any changes or amendments will be posted on our Sites prior to such changes or amendments taking affect. If we make any material changes, we will notify you by email or by means of a notice on our Sites prior to the change becoming effective. If you do not accept such modifications, you must discontinue use of our Sites and Services. Otherwise, continued use of our Sites and Services constitutes express consent to the new Policy. We encourage you to periodically review this page for the latest information on our privacy practices.
INTERNATIONAL USAGE
Our Sites and Services are controlled, operated and intended for use within the United States. MouthMedia makes no representation that content, materials or products available on or through our Sites and Services are appropriate or available for use outside of the United States. If you access our Sites and Services from a location outside the United States, you are responsible for compliance with applicable laws, including local laws regarding privacy, online conduct and content and U.S. export laws and regulations.
CALIFORNIA CONSUMER RIGHTS AND NOTICES
California residents may request and receive information about our privacy practices, and compliance with applicable provisions of California law, including a notice describing the categories of personal customer information we may have shared with third parties for marketing purposes and the contact information for such third parties. California residents should email us at legal@mouthmedianetwork.com to make such a request. Any California residents under the age of 18 who have registered to use the Services, and who have posted content or information on the Services can request that such content or information be removed from the Services by contacting us by email at legal@mouthmedianetwork.com, and making such a request stating that they personally posted such content or information and detailing where it is posted. We will make reasonable, good faith efforts to remove the post from prospective public view or anonymize it so the minor cannot be individually identified. This process cannot ensure complete or comprehensive removal. For example, third parties may have republished the post and archived copies may be stored by third parties over whom we have no control.
